4.2. The SELLER is obliged to provide the contractual service free of defects, completely, and in conformity with the order specifications.
4.3. Performance of the service requires that this Agreement has been confirmed electronically and the service fee has been paid.
4.4. The SELLER shall not be held liable for temporary service interruptions arising from planned system maintenance, internet infrastructure failures, cyberattacks, or similar force majeure events. However, in the event of interruptions exceeding 48 hours, the BUYER's rights under TKHK Article 11 are reserved.
Article 5 — Right of Withdrawal and Exception
5.1. As the service subject to this Agreement qualifies as a "service performed immediately in electronic environment" under Regulation Article 15/1-(ğ), the right of withdrawal cannot be exercised provided that the following conditions are met together:
- The BUYER has explicitly requested immediate commencement of the service's performance, and
- The BUYER has accepted in advance, via a separate consent mechanism, that they will lose the right of withdrawal upon commencement of performance.
5.2. The withdrawal right waiver consent (checkbox) in the purchase flow is collected independently of the auto-renewal consent. The purchase cannot be completed without this consent.
5.3. Where the right of withdrawal cannot be exercised, the BUYER's rights regarding defective services (Article 7) remain reserved.
Article 6 — Subscription Cancellation
The non-applicability of the right of withdrawal does not prevent the BUYER from cancelling their subscription.
- Cancellation takes effect from the next billing period.
- Access to the service continues until the current period ends; no refund is issued for the used period.
- Cancellation may be made via the user panel or by written notification to
support@cvisioner.com.
Article 7 — Protection of Personal Data
The SELLER processes the BUYER's personal data in accordance with the KVKK Privacy Notice under Turkish Personal Data Protection Law No. 6698. Processing of CV data for AI analysis purposes is based on the explicit consent provided by the BUYER during the registration flow.
Article 8 — Default
In the event that the BUYER defaults on payments made by credit card, the BUYER acknowledges and undertakes that they will be liable for interest and other obligations to the card-issuing bank under the credit card agreement between them; the SELLER is not a party to that relationship.
Article 9 — Payment Disputes (Chargeback)
The BUYER is required to notify the SELLER at support@cvisioner.com before disputing any payment. The SELLER will evaluate the notification and respond within 7 business days. In the event of a bank chargeback initiated without prior contact with the SELLER, the SELLER reserves the right to submit transaction records and approved contract documents to the relevant bank.
Article 10 — Competent Authority
For disputes arising from this Agreement, within the monetary limits announced annually by the Ministry of Trade:
- Consumer Arbitration Committees at the BUYER's place of residence,
- Consumer Courts have jurisdiction.
Article 11 — Entry into Force
Upon completing the payment, the BUYER is deemed to have read, understood, and accepted all terms of this Agreement.
